A British father who caused the death of his two-year-old son on the first day of a family holiday in Cyprus has avoided a prison sentence. Joshua Foster, 37, broke down in tears at Paphos District Court as he was ordered to pay a €3,000 (£2,500) fine following the tragic accident.

The harrowing incident occurred on July 12 at the five-star King Evelthon Beach Hotel and Resort in Chlorakas. Foster had lifted his young son toward a fourth-floor hallway window so the child could view the hotel’s waterpark.

Believing the glass pane was fully closed, Foster placed the boy near the opening but a section of the window was open. He lost control and the toddler fell nearly 40 feet. Emergency responders rushed the toddler to Paphos General Hospital but doctors were unable to save him.

Court verdict and lifelong remorse

Foster pleaded guilty to causing death through a reckless, rash, or dangerous act. During sentencing, District Judge Froso Christodoulidou noted the extreme distress and remorse demonstrated by the father.

Observing that Foster would carry the pain and guilt of the accident for the rest of his life, the judge concluded that a financial penalty was appropriate given the heartbreaking circumstances.

Following the brief 25-minute hearing, Foster embraced his defense team and parents before leaving the court complex.
