Halle Berry and her ex-husband Olivier Martinez are facing a new development in their long-running custody dispute involving their 12-year-old son.
Olivier Martinez claims against Halle Berry
According to documents obtained by PEOPLE, the Unfaithful actor sought a temporary restraining order against Berry over allegations involving their son, Maceo.
He claimed Berry physically abused the 12-year-old during an alleged Septemver 26 incident, accusing her of jumping on him and placing her hands around his neck.
“While the September 26, 2026, incident in which Petitioner choked our son is the latest incident of abuse, I contend that there have been other instances of abuse over the course of the last few years,” the filing alleged.
He added, “These other incidents involve additional physical attacks against our son, as well as verbal and emotional abuse from Petitioner to me.”
Martinez’s lawyer Patrick Baghdaserians said his client’s “paramount concern is the health, welfare and the safety of the minor child, hence the action that he took in court by filing the request for domestic violence restraining order. The second concern would be for mother to get the appropriate help that she needs to address her issues so she can better herself, which would in turn help the minor child moving forward.”
Martinez’s attorney called him “a loving parent” focused on protecting their son.
Halle Berry’s reaction over Olivier Martinez claims
While Berry’s attorney Marina Beck dismissed his filing as “entirely meritless and deliberately misleading,” saying Berry remains committed to Maceo’s best interests.
“To say this filing is entirely meritless and deliberately misleading would be an understatement,” Beck said, later adding, “Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”
Olivier Martinez granted temporary restraining order
Following his allegations that Halle Berry physically abused their 12-year-old son, Maceo, Olivier Martinez was granted a temporary restraining order on October 1.
A Los Angeles County judge also temporarily modified Berry’s visitation, allowing partial custody to maintain contact with Maceo while declining Martinez’s request for monitored sobriety, citing “insufficient information.”
