Sean Diddy Combs' lawyer has filed an appeal to release the music mogul from jail before his trial.
His attorney Alexander A.E. Shapiro submitted the filing in the U.S. Court of Appeals for the Second Circuit on Tuesday.
According to the documents obtained by PEOPLE, Combs, 54, "was not released pending trial, even though he offered to comply with restrictive conditions that would have prevented any conceivable risk of flight or danger."
However, his lawyer Shapiro believes that the court "rejected a plainly sufficient bail package" for his client and "violated its obligations under the Bail Reform Act."
The filing read, "Mr. Combs is presumed innocent. He traveled to New York to surrender because he knew he was going to be indicted. He took extraordinary steps to demonstrate that he intended to face and contest the charges, not flee.”
On September 16, Combs was arrested on the charges of racketeering, sex trafficking and transportation to engage in prostitution.
The It's All About The Benjamins hitmaker is currently being held in Brooklyn's Metropolitan Detention Center.
To note, Combs' next court will take place on October 10, 2024.
